What happens when the UN disappears entirely, with no successor treaty and no transfer of functions
Introduction
The hardest version of the succession problem is not the loss of the depositary role. It is the collapse of the institution itself when the United Nations is not merely the custodian of a treaty, but one of its principal parties, an implementing organ, a financial channel, and the administrative center of execution. In that scenario, the question is no longer who holds the documents. The real question is whether the treaty still has a living contracting subject left to perform it.
The Core Thesis
Claim: If the UN is a principal treaty party and is fully dissolved, the treaty loses its main party. That is a structural failure, not an administrative inconvenience. The depositary function becomes secondary, because a depositary can preserve records but cannot replace the party that the treaty was built around.
A treaty cannot operate normally when the institution that carries obligations, contributions, decisions, secretariat functions, and implementation powers no longer exists. If the treaty does not contain a built‑in succession mechanism, there is no automatic transfer to a new actor.
Why the Treaty Collapses
In many international arrangements, the UN is not a passive name on paper. It may be the contracting party, the executor, the funding mechanism, the dispute‑processing framework, the secretariat, and the administrative infrastructure all at once. When that structure disappears, the treaty may become impossible to perform. A non‑existent party cannot vote, finance, supervise, coordinate, or fulfill duties.
This creates three possible outcomes: automatic termination, functional paralysis, or partial survival. Which result follows depends on the architecture of the treaty itself.

Automatic termination: This is the strongest outcome. It arises where the UN is a necessary party and the treaty cannot operate without it, such as a constitutional or foundational framework tied to the existence of the organization.
Functional paralysis: The treaty may still exist formally, but the core machinery stops working because no other actor can legally or practically take over the UN role.
Partial continuation: Some treaties can continue among the remaining states if the UN was only an additional party and the other parties can still implement the instrument without it.
Why the Depositary Question Becomes Secondary
The depositary is important, but it is not the treaty itself. A depositary can receive signatures, circulate notices, and preserve the record. What it cannot do is supply a missing contracting party, substitute for a vanished institution, or manufacture legal continuity where the treaty architecture does not allow it.
In the hard case, the central issue is not archival continuity. It is contractual survival.

What Happens to Human Rights and International Justice
The most fragile regimes are usually the ones that depend on UN monitoring, UN finance, UN reporting, and UN field structures. Human rights bodies, peace operations, investigative missions, and similar mechanisms may continue to exist only in name if the institutional foundation disappears.
By contrast, independently constituted mechanisms such as state‑based courts or treaty systems with their own legal personality have a better chance of surviving, even though their practical effectiveness may drop sharply without coordination, funding, and enforcement support.
International Justice Under Pressure
The International Court of Justice is structurally tied to the UN order, so its legal position becomes uncertain if the UN itself is dissolved. In the short term, it might continue to function physically, but its institutional foundation would be deeply damaged.
The International Criminal Court is different. Its existence is based on a separate treaty structure, so it is more resilient. Yet even there, practical enforcement depends on state cooperation, arrest, evidence collection, and funding.
Ad hoc tribunals created through UN machinery are the most vulnerable. If the institutional base disappears, the tribunal may lose the very authority and logistics that make it operational.
The Practical Takeaway
When the UN is a principal contracting subject and then ceases to exist, the legal problem is existential. The treaty does not merely lose its depositary. It loses the institutional personality that made performance possible in the first place.
That is why this scenario is fundamentally different from a simple transfer of documents or a routine change in depositary arrangements. Without a successor treaty, without a transfer of functions, and without a clear replacement institution, the treaty either collapses, becomes dormant, or survives only in a much weaker and more fragmented form.

The hard case is therefore straightforward in principle: if the UN is itself a main treaty party and is completely dissolved, the treaty may lose its operative foundation. The depositary is not the decisive issue. The decisive issue is whether the treaty can still exist without the party that was built into its structure.
